The Initial Agreement & Deposit

Once you accept an offer, we move into contract.

In Colorado, both parties sign a Purchase Agreement, and the buyer submits an earnest money deposit to a neutral third party, typically a title company or closing attorney, who acts as the escrow agent.

The escrow agent:

  • Holds the buyer’s earnest money
  • Manages the flow of funds
  • Ensures all conditions are met before closing

Under Colorado law, earnest money serves as consideration and is held pending the fulfillment of contingencies outlined in the contract.
